The Marxist theory is composed of the scientific world view and methodology. It clarified the trend of the development of the human society, the general rules of social internal movement and the relationship between man and nature etc. It also instructs us the scientific method of observing and studying things, by which we can explore the unknown world in depth. Marxism is so broad that it refers to almost all fields, including human and civilization, politics and economics, philosophy, democracy and legal system, nation and population, art and aesthetics, religion, war and peace, science and technology and so on.Due to some reasons, we found that in Marx's masterpiece, it always criticized the reality system, argued with different ideas, and clarified the ideal goals simultaneously. Therefore, the thought of human rights does exist in the grand Marxist system, though it hasn't been introduced independently. There may be some doubts and misunderstandings in understanding the thought of human rights, thus it's very important to explore it morally and logically. Marxist thought of human rights plays an important part in the scientific system of Marxism, and it is also the ideological weapon of self-liberation for the proletariat and workers.In the paper, I hold the viewpoint that human right is of a class nature and it is a tool of the governing class. The socialism countries use the human rights to eliminate different classes and exploitation in order to make sure that its citizen may share the human rights. The human rights also enjoy the development in line with the society, it enlarged its board from private right to collective right, from political right to economic and cultural right. The human right is also limited by the region, that's to say, the human right is based on the sovereignty.The Marxist Thought of Human Rights has the ideas as follow: Human rights are of a class nature, which is for the ruling class. The purpose of the human rights under the socialist state is to eliminate classes and exploitation, at last realize the universality of human rights etc. Human rights are of a historical nature, with the development of human society, human rights developed from individual rights to collective rights, from political rights to economic and cultural rights. Human rights are restricted by realm, because the law which aims to protect the human rights are different from counties to counties. Thus, the achievement of human rights is based on the sovereignty.Nowadays, there are many researchers who did some respective study in Marxist thought of human rights and national indemnity system, the creative point of this article is to combine these two parts together. The article starts from the mainstream theories of human rights all over the world, discuss mainly upon the Marxist theory of human rights, and researches into the sciences and truth of the Marxist theory of human rights. By thinking and developing the classical writers'works on the Marxist thought of human rights, we probed the new development and new applications of human rights in the social practice. The paper can be divided into six parts: introduction, body (4 parts), and conclusions, as follows in detail:Introduction: an overview of the globalization background of human rights thoughts, indicate there can't be a definition of human rights universally, because of the conflict in the definition of human rights in western part and the eastern part of the world.The first part gives an overview of the Western mainstream theories of human rights, generalizes the proponents, main contents and the characteristics of the three kinds of human rights theories including the theory of natural rights. And then leads out the Marxist thought of human rights, and describes the origins and development of it briefly which aims to prepare for the research following.The second part focuses on the Marxist thought of human rights. Firstly list a large number of human rights discourses, from Marx to Engels, in order to summarizes the main ideas of the Marxist thought of human rights, and then divided them into different classification as economy, history, class, nation, development, liberty and so on.The vitality of Marxism lies on its development, and then the paper introduces the development and innovation by Marxist classical writers on the Marxist thought of human rights. Because of the different social background and social conflicts, there have different key points in human rights research. Finally, the author draws a conclusion on the basis of the former scholars.The third part puts the Marxist thought of human rights into practice. As the protection of human rights, the national indemnity system is crucial, and this part is a link between the preceding parts and the national indemnity system. The development of Marxist thought of human rights will inevitably lead to the establishment and constant improvement of state indemnity system. Guided under the human rights thought, we may analyze the regime of the national indemnity system.The fourth part discusses the deficiencies of the state indemnity law which serves for the proletariat. The State Indemnity Law is to be formulated and implemented according to the requirements of the human rights'protection, so this part should in view of the Marxist thought of human rights, and then discuss the deficiencies and consummation of The State Indemnity Law as following 4 aspects:indemnity scope, indemnity standards, indemnity procedures and supervision procedures.
