Study Of Law And Economics Related To Education Through Labor System

Education through labor system (ETLS) has lasted for 50 years in China. It has successfully saved a lot of minor criminals, and safeguards the country's political stability and social stability, preventing and reducing crimes. ELTS has made outstanding contributions. It has become an important part of legal system with Chinese characteristics. At present, the acceleration of the rule of law and international human rights in the context of an increasingly acute struggle, ETLS has become the focus that national and even international law scholars and human rights organizations talk over. Law and economics as a cross-edge of economics and law disciplines, it use viewpoints and methods of economics to analyze on ELTS, which will no doubt study the issue in future broader space.So far, the domestic academic research labor education system in our country still in the stage of pure legal theory, a lot of ETLS, the academic progress of related issues have been hesitant to enter a dead end. For example, for the choice of legal status of ELTS, there are three different viewpoints:the first view resists that ELTS should be adhere to the status of the administrative penalty; the second view is that ELTS should be used as a measure of criminal punishment, or directly as a penalty fine of one species; A third view holds that theory of security measures from abroad, the labor camp as a security measures, supplement or replace the use of punishment. If the economic tools such as cost-benefit analysis introduct into the research on some issues, we will get more intuitive quantitative analysis.
