The Study Of Resale Price Maintenance Regulated By Antitrust Law

Resale Price Maintenance is the agreement which is formed by someone forces. The Resale Price Maintenance always limits the intrabrand competition and restricts the sale systems. As one of typical vertical restraints to market competition, Resale Price Maintenance has been increased in our economic life, and limited the competition on the market and damaged the interest of the consumers. In order to inhibit the negative effection of Resale Price Maintenance and remain the energy of the market, it is important to research the Resale Price Maintenance and establish the appropriate institution adaptable to Chinese features. Many developed countries have researched the Resale Price Maintenance deeply. However, there are few research about the Resale Price Maintenance in our country, and the articles in Antitrust Law about the Resale Price Maintenance are simple. Therefore, the author takes the liberty of analysis of Resale Price Maintenance hoping to be of some assistance for both the theory and practice.The paper has five parts.At the beginning of the paper, the author introduct several cases about the Resale Price Maintenance and question the Article 14 and Article 15 in the Antitrust Law.Chapter one is about basic theory of Resale Price Maintenance providing the foundation for next dissertation. It gives the definition of Resale Price Maintenance and classifies it. In chapter two, the author takes the American RPM and European Union's RPM as examples, introduces the per se rule and rule of reason.In the part two of the chapter, the author summaries the EU RPM and compares the American RPM with EU RPM regulation institution in the part three at this chapter.Chapter three concludes the regulation models and focuses on the conclusion of RPM in our country's Antitrust Law. After the analysis on our Antitrust Law, the author gives some advises to perfect our nation's Antitrust Law.At the end of the paper, the author does the main conclusions of this article.
