Research On The Feasibility Of Virtual Property Being The Object Of Larceny

The virtual property has been stepped into people's horizon with the rapid development of Internet Online Game Industry. Facing the ample cases concerning the virtual property, the disposals of these cases are quite different from area to area in separate public security departments and the judiciary departments. This divergence has arson our debates on the following issues: If the virtual property belongs to the property? Can the virtual property be protected by the criminal law? Is the action of thieving virtual property included into the crime of larceny? As to the up-going issues, there is no particular article in our present criminal law. On the other hand, there is no agreement among the scholars.Nearly no industries can avoid the impact facing the fiercer global financial crisis. However, the industry of Internet online game hasn't been shocked a lot when the other industries are making efforts to survive up. Because of the increasing pressures from the economy and actual lives, more and more people are now looking for online game to relax and relieve. Under this situation, the industry of Internet online game is facing a unique opportunity to boom. Secondly, it also becomes an important force to promote the overall economy. However, as to the cases of virtual property, the divergent disposals in the judiciary areas have became a bar to the boom of the online game industry as well as the protection of the legal rights from the concerning parties. To some extents, it will influence the overall social harmony and steadiness in the long run. In this way, it urgently requires us to come out the relative law and regulations to protect the concerning parties and the whole society.In addition, the writer organized this thesis under the pattern of What-Why-How. In the first part of this thesis, the writer put up the impact of the virtual property to the traditional objects of larceny after analyzing the traits of the objects of larceny and the virtual property. And in the following chapter of this paper, the writer analyzed the probability and the feasibility of the virtual property being the objects of larceny. In the writer's opinion, the virtual property should be and must be included into the objects'scope of larceny according to the current situation. At last, the writer put forward the relative advices on the improvement of the virtual property's legislation.
