A Study On The Selection System Of Bankruptcy Administrator

The purpose of bankruptcy law is to preserve interests of creditors and liquidate impartially and efficiently. According to the provisions of the present law, the bankruptcy administrator works during liquidations, revival and compromise performing its functions and duties such as assets account, operation maintenance, exercise of debtor's rights and disposal of debtor's property. The bankruptcy administrator carries out the balance of interests of creditor,debtor and stuffs of the bankruptcy company. The bankruptcy administrator is the core to the bankruptcy procedure. The construction of the selection system of the bankruptcy administrator affects the efficiency and fairness of the bankruptcy procedure.There are four chapters in all such as introduction of the bankruptcy administrator, legal status of the bankruptcy administrator, defect of the selection system and suggestion.Elementary knowledge about the bankruptcy administrator is introduced in the first chapter such as the concept, history, feature and legislation of the bankruptcy administrator. It's helpful to understand the selection system.Elementary knowledge about legal status of the bankruptcy administrator is introduced in the second chapter such as the necessity of the research on the legal status of bankruptcy administrator, introduction of many views. To define the legal status of the bankruptcy administrator is prior to the construction of the selection system of bankruptcy administrator.Elementary knowledge about selection system is introduced in the third chapter such as subject, time, qualification, procedure and supervision. The method of comparative analysis was adopted.Elementary knowledge about defect of the selection system and suggestion is introduced in the forth chapter such as defect of the selection system and suggestion. There are some problems such as the legal status lacking clarity, the subject lacking supervision, lists of administrators which only belies its name. It is better to define the legal status, improve the supervision system, carry out the list system of administrator and make administrators professional. The right of creditor to object shall be protected and system of liquidation group shall be abolished.
