Reaserch On The Direct Claim To The Third Party In Marine Liability Insurance

The purpose of maritine liability insurance is originally to protect the insured, but with the development of society, its center of protection has gradually inclined towards the third person suffering the infringement by the insured,and whether or not the third person can enjoy the right to directly claim the payment of the insurance money from the liability insurer plays an important role in protection of the third person's interests.The protection of the third person's interests has been the trend of modern liability insurance law. Unfortunately, however, so far there has not been any perfcet system about the right in national society, so the study is valuable.On the basis of synthesizing the viewpoints of various schools, borrowing ideas from the direct claim to the third party system in the existing maritine liability insurance, combined with the specific conditions in China, the thesis gives a preliminary study ons ome fundamental problems of the third party's direct claim system in maritine liability insurance, such as the research value of the system,the theoretical foundation, enforcing eonditions as well as the defense of the third party suffered and put forward legislative proposals.
