The Influent Of ALI'S Intellectual Property Jurisdiction And Recognition Of Judgments And Suggestions

With the fast development of science and technology,intellectual property which has been an important wealth is a vital resources to push forward the society.Nowdays the development strategy of our country is initial innovation and international cooperation which makes the economic and technological exchange has been frequent and the number of crossnation intellectual property litigations increase rapidly year by year Under this circumstances, how to provide better protection for intellectual property with private international law has become an urgent problem to be resolved In the past few years, many developed countries especial American, have paid more and more attention to and made many efforts on protection of intellectual property with private international law.China has entered some international conventions of intellectual property and acquired achievement in this field in the past twenty years, but still drops behind on intellectual property protection with private inter law,especially on jurisdiction and recognition and enforcement of judgments.We should actively learn and absorb the beneficial components of jurisdiction and recognition and enforcement of judgments system in other countries so that we can make our intellectual property protection system more perfect.The first part introduces the rules made by ALI and put the focuses on main introduction of jurisdiction and recognition and enforcement of judgments.The second part discusses what China should learn from the rules made by ALI on the jurisdiction of international intellectual property.The third part discusses what China should learn from the rules made by ALI on the condition of recognition on overseas international intellectual property judgments.The last part gives several advices on jurisdiction and recognition of judgments in China on the basis of the analysis above.
