On The Abolishment Of Juveniles' Criminal Record

In the field of criminal law to minors, the abolishment of criminal record has been accepted into the legislative and judicial system by many countries as the socialization and reprieve of penalty developed, and it graduates into a worldwide trend now. This paper lists several arguments about the conception of criminal record and come up the definition in my own opinion at first, point out that the criminal record should be defined as the fact that the doer was convicted or punished because of his crime. Then emphasizes on these questions below on the basis of the definition:the definition of abolishment of criminal record, the theoretical basis of the abolishment of criminal record, the legislation and consequence of criminal record in our country, the relationship between the physical and mental particularity and the abolishment of criminal record, the provision of juveniles' criminal record abolishment in criminal legislation overseas. Then analyze the necessity and feasibility to establish the juveniles' criminal record abolishment system in China, and the assumption of how to establish it. At last come to a conclusion that it is reasonable to build this system for the benefit of juveniles. We should combine the advanced legislation and experiences of other countries together with the actual situation of the protection for juveniles in China, and then set up the juveniles' criminal record abolishment step by step. Not only the legislative and judicial organization, are needed to make sure that this procedure can go on wheels,but also the cooperation of civil authority and community. We should not only abide by the guidance of legislation, but also change the opinion and build a set of institutions to implement the legislative spirit of protecting juveniles into everybody's activity and help the juveniles who have ever made an unpremeditated crime to return to our society successfully.
