On The Prevention Of The Victim In Violent Crime From The Perspective Of The Victim

The focus of the previous researches in the prevention of violent crime and the related problems lies in the subject of the crime, whereas the victim as the sufferer of the crime has long been neglected both in theory and in practice. However, with the further development and empirical need of the criminology and criminal policy-science, the method of analyzing the prevention of violent crime only from the perspective of the offender has been increasingly lagging behind. It has become the main trend to integrating the offender with the victim, to take miscellaneous factors into account, as well as to study the prevention of violent crime from a changeable point of view. This thesis consists of three parts to discuss the prevention of violent crime. So studies the theory of victim, and the major factors leading to the violent crime, for the factors of being killed running through the event from beginning to end. Analyzing the victim in the violent crime from the angle of murdered factors not only unfolds clearly the characteristics and influences of the various factors, but also lays the theoretical basis for the prevention of the violent crime. Under the guidance of the theory of factors, this thesis investigates the time, space, and the factors of being murdered, and then further analyzes the influences of carrying out violent crime and being murdered. The influences of the victim on the violent crime on the basis of the murdered factors are discussed. The following problems are involved: the law of the interaction between the major victim and inflictor, the fault of the victim, and the identification of the victim. Though the analysis of these problems, it provides diversified angles of views on understanding the violent crime in order to understand thoroughly the victim, and to pave the way for the following chapter in studying the preventions of the victim. The key to solving the problem, studies the methods of preventing from being the victim in violent crime. Firstly, by means of induction from the living examples, the author analyzes the laws of three tupes of victims--robbery, intentional injury, family violence, and finds out the generality of the victims of the violent crime from the specific cases, and consequently puts forward the corresponding measures of preventing from being injured. Then, through the investigation of the victim's mentality and the ability to take precautions against the crime, and the combination the subjective and objective factors, the author endeavors to find out the crucial points to improve the precautious measures. Finally, the author further takes into consideration of the institutional guarantee of the prevention of the victim, and puts forward some suggestions and ideas about improving the institution and guarantee mechanism.
