China maintains close ties with Africa in economic and trade exchanges for over a decade, and the direct investment in Africa is growing. Many African countries which China invests in are characterized by political instability and frequent wars, all these pose a severe test for Chinese investment safety in these countries. The best way to guarantee investment security is the signing of bilateral investment treaties which are sound, workable, enforceable.In order to protect and promote investment in Africa. Chinese government so far have signed bilateral investment treaties with 32 African countries. By 2010, 12 signed China-African bilateral investment treaties had expired to be re-signed. With the changes in international economic situation and the improvement of international investment law, the contents of bilateral investment treaties are innovative. In order to protect Chinese overseas investment, signing a contract with African countries conforms to the international political and economic situation, while absorbing the up-to-date bilateral investment treaties is especially important. In order to signed a China-African bilateral investment treaty, it is of great significance to elaborate and make comprehensive analysis to the existing China-African bilateral investment treaties.This paper compares the overview of development of bilateral investment treaties with China-African bilateral investment treaties, shows that the signing of China-African bilateral investment treaties conforms to the historical tide. It also symbolizes that China has gradually changed from a capital input country to a in capital-importing and exporting countries, and explains that why most BIT between China-African countries originally sprang from German BIT. Then this paper introduces the main content of China-Africa bilateral investment treaties, and compares the Chinese investment in Africain with the number of signed BIT in recent years, concludes that the signing of China-African BIT and the Chinese investment in Africa goes together, and each other promotes the conclusion. This article also describes and analyzes the characters of the China-African bilateral investment treaties, particularly stressed the description and analysis the standard of treatment. expropriation compensationand dispute resolution of the China-African bilateral investment treaties. and compares it with China-EU bilateral investment treaties, China-Asia bilateral treaties and China-Latin America which are signed recently on this base. The conclusion of this comparision is that China-African bilateral investment treaties have a number of ambiguous definition and terms.
