On Prosecutor Assistant System In China

In China the establishment of Prosecutor Assistant System has important theoretical and practical significance to advance the prosecutor professionalization, promote the reform of procuratorial organs and personnel system, perfect the operation mechanism of judicial system and so on. First, proceeding from the concept of prosecutor assistant as well as the analysis and deliberation on this system of other countries and regions, this thesis has an overview of Prosecutor Assistant System. Second, it demonstrates the necessity and feasibility of establishing this system in our country from the theoretical and practical level. Third, it describes the legal relation between prosecutor assistant and prosecutor, assistant prosecutor, court clerk, judicial police and other supervisory personnel, and their professional division of labor. Last, this paper tries to construct Prosecutor Assistant System from such aspects as prosecutor assistant's legal nature, basic duties, employment and tenure, resignation and dismissal and retirement, management and assessment, and staff ratio.
