P.R.C. Insurance Right Of Subrogation

As the insurance law of P.R.C., revised and adopted on October 1, 2009, makes no material change on the rules of right of subrogation, and no relevant laws regulate detailed rules on the insurance subrogation, which creats a series of diffficult problems in the legal practices of insurance subrogation, which legal professionls cannot reach uniform legal research model or uniform rules in judging, the Paper, based on the theory of subrogation, is to analyse the natures, functions and application scopes of the rules of insurance subrogation by the means of comparation with similar laws and regulations; is to research the issues on how to exercise the right of insurance subrogation with reference to a series of insurance lawsuits the author dealed with before; is to classify and analyse the influence by"disposal of compensation claims by insured party subject to the third party"to"the exericise of insurance subrogation by the insurer".
