The item 106 of "Property Law" clearly regulates that bona fide acquisition includes chattel and real estate, thus ending the argument in theoretical circle about whether the real estate can be applied to bona fide acquisition. But there are a lot of problems arising in practice because of the various cases and theoretical basis of decisions, which has serious impact on the effectiveness and the trial justice. The above facts reflect that there are different understandings of bona fide acquisition of real estate in judicial circle, which contributes to judicial confusion to some extent. Combining the existing research results and taking a case of false house selling as an example, this article analyzes the concept, development and components of bona fide acquisition of real estate in our country, focusing on the application of stolen goods in bona fide acquisition, and finally on the thinking raised by this case to look forward to being beneficial to judicial practice.This article is divided into four parts:The first part describes the basic facts and focus:people's thinking about bona fide acquisition of real estate from the case of false house selling.The second part, the good intentions obtain the system outline:Introduced specifically the good intentions obtain concept, basis of existence and development process.The third part makes a legal analysis of the case by reviewing the elements making up bona fide acquisition and the impact of the stolen goods on the application of bona fide acquisition to draw a case conclusion.The fourth part makes a few shallow reflections on the registration errors of liability made by registration authority.The fifth part:Ponder which initiates by the case.
