On The Improvement Of The Legal Liability System Of Anti-unfair Competition Law

The legal liability system is the guarantee of the implementation of the Anti-unfair Competition Law. A perfect legal liability system is very critical to realize the legislative intent of the Anti-unfair Competition Law, specifically, to regulate the unfair competition behaviors and remedy the victim's loss more effectively. There are lots of short-comings in our country's legal liability system of the Anti-unfair Competition Law. In this essay, after introducing three typical countries'legal liability systems, the author makes an effort to re-construct the legal liability system of our country, while bringing out several advices to make the system better conform to our country's legal practices. Four parts are included in this essay. In the first part, the author establishes structure and the legislative model of the legal liability system, in order to lay the foundation for the research of the next three parts. In the next three parts, the author discusses administrative liability, the civil liability and criminal sanction one by one, including the theoretical foundation and details of setting of the three forms of legal liability. By the reflection of our country's legal liability system, the author intends to realize a target, which includes the break-up of the administrative-led system, the strengthening of the civil liability and the improvement of the provision of both the three forms of legal liability.
