Research On Legal Problems Of Electronic Money

Electronic money, as a technological and financial innovation, brings convenience and efficiency to people's economic and social life. In the meantime, it certainly produced the risks and problems which can not be regulated by the existing laws. With the increase of turnover in electronic money, the subjects of electronic money operating system, even the whole society are all facing the potential risks. Currently, the situation of supervision represents imperfect and not systematic, therefore, it's necessary to systematically perfect the legal system pertaining to the electronic money operating system. Based on the electronic money operating system, this paper tries to analyze and research on the legal problems in five aspects: the concepts of electronic money, the abstract model of operating system, the legal relation between the subjects, the legal risks and problems of electronic money and the perfection of legal system and laws.The thesis includes five chapters.In the first chapter, the article presents the generation and the development trend of electronic money, and makes a new definition on electronic money, and analyzes and summarizes the characteristics of electronic money. On the basis of expounding connotation, extension and legal characteristics of electronic money, the article shows the relation and difference among electronic money and similar concepts. In the second chapter, the article analyzes and summarizes the model of operating system in practice. Based on the categorization of electronic money, the whole electronic money running procedure is divided into issuing stage and payment stage. The article defines the subjects in electronic money respective stage and the behaviors between the subjects above.In the third chapter, the article analyzes the legal relation between the electronic money subjects. Based on the subjects and behaviors analyzed in the second chapter and operating ways of electronic money in practice, the article analyzes the legal relation between the subjects. In the fourth chapter, the article analyzes the existing risks and problems of electronic money, includes the following aspects: market environment, the liquidity of currency, system and operation, the credit of subjects.In the fifth chapter, based on the running system in practice, the legal relation between the subjects and existing risks and problems, the article puts forward a concept of 'electronic money central supervision system' and a new model of electronic money running system, and presents legislative suggestions and perfection of legal supervision system in the following areas:supervisory system,the supervision of subjects, guarantee and relieving system, internal management system and risks control system, market and related legal system.
