On the alert of American sub-prime mortgage crisis, this paper is to explore the legal protections against Chinese commercial bank housing loan risks.Since 1998, Chinese real estate market has been stepping into a fast growing period and it in turn encourages immerse growth of personal housing loans. From then on, balance of personal housing loans and credit scales mounts up rapidly. Therefore commercial banks fall into cut -throat competition and financial inventions take place in succession. However, personal housing loan business is still young in China. The market itself is far less mature and experienced. We are also lacking of related law system and policies, sophisticated personal credit system, and risk protection mechanism, so after recent development, risks of this new-rising business to Chinese commercial banks are emerging. After the breakout of global financial crisis triggered by sub-prime mortgage crisis, the volume of non-performing personal housing loans is mounting up. Therefore problems and risks hidden in this business are also disclosed. Although securitization has not been introduced into home mortgage and sub-prime mortgage, to secure personal loans safety and better development it is imperative and critical to strengthen the management of personal housing loans and improve related legal protections.This paper discusses the current situation and risks of personal housing loans and raises measures to protect from such risk's outbreak and to complete related legal system. In Section I, it introduces current situation and problems existing in personal housing loans practice under data analysis and present practice review; in Section II, it discovers major risks to personal housing loans by case analysis of business practices; in Section III, it explores cause of formation of such risks in personal housing loans by case analysis; in section IV, for the sustainable development of commercial bank personal housing load business, from legal system point of view, it concludes conceive of legal protections against personal housing loans risks and raises corresponding solutions to different risks.
