Personal Information Protection By Civil Law In The Net Age

The computer network technology made it faster, cheaper and more convenient to handle and spread the information. Actually, because of this convenience and the drive of profit, personal information abuse became more and more serious. The protection for personal information has become an inevitable issue in this network era. We didn't constitute any specialized laws on this issue so far, it's not beneficial to protect both the personal rights of citizens and the development of economic society. We cannot restrain the abuse of personal rights unless a system is established to control the situation. Enhance the research of personal rights protection and to constitute related laws as soon as possible are two effective ways to accomplish both the economic values and personality values of personal information.We still at the early stage of the research on personal information protection. There is still theory diverge on the connotation and extension of personal information, the rights basis of personal information protection and the rights of personal information owners. From the perspective of civil law,this article is about to research the theory basis of personal information protection and its main problems. Through the analyze of other countries'effective patterns, especially the U.S and German's, this article is hoping to give some helpful suggestions to establish and perfect the personal information protection by civil law.
