Operational Investigation And Legal Consideration Of The Metro Underground Space Development In Guangzhou

Our Urban development achieved great success has accompanied with the rapid economic development since the implement of the policy of reformation and opening According to the prediction of The State Council Development Research Center in 2001, the urbanization level of China would increase to 60% in intending 20 years. In fact, the development speed of the urbanization does match the prediction. With the speeding up of urbanization and increase in population, the living space of human beings is becoming smaller and smaller, the highly concentration of essentials cause the negative effect due to the limitation of the land resources in our country. Citizen enjoy the life from modern material civilization, as well as unavoidable suffering to the"city syndrome", such as traffic jam, environmental pollution, lacking of resources and puzzling the urban land, energy, space and time waste at the same time. To achieve the purpose of controlling the urban growth, but also increasing the urban capacity and human living space, relieving traffic congestion, and less occupied land, the development of urban underground space would be an inevitable trend. This thesis is based on the research materials of the Guangzhou underground space development as fundamentals and it has analysed the present situation of the development of underground space, legal basis and so on. Besides, I combine with the new requirements of urban construction, from multiple opinions especially the view of law, committing ourselves to find the perfect solution for the development of the urban underground space of laws and regulations, and confronting the difficulties during the development of underground space. This is divided into four parts:For part one, it introduces the basic situation of the development of underground space in Guangzhou. To introduce the internal motivation of the underground space development and main operational mode in Guangzhou, but also with the evaluation for underground space development and practical effect.The second section focuses on the discussion of the legal basis for underground space development in Guangzhou. For Guangzhou metro, I reorganises the legal basis for underground space development and paying attention to the development trend of the international urban space development.The third part of Guangzhou metro, it analyses the legal obstacles of the underground space development, and emphasized on discussing the difficulties of legal problems.The fourth part is the most important part, and also the innovation that I try to demonstrate. Based on the fundamental analyses of the existing problems of the underground space development of Guangzhou metro. I advised further completed countermeasures and suggestions for underground space development and legal regulation.In thisthesis that the future of our country's urban underground space development and utilization of the greate development is facing unprecedented historical opportunity but must follow the legislation of provinces and country in order to improve the regulations of the development of underground space, ensure legal regulation for the unity of underground space development, legitimacy and social benefit maximization.This thesis emphasizes that combining theory with practice, and also the actual investigation and legal thought. Based on the research and practical analyses of urban underground space development and perfection of laws and regulations, this thesis is with practical significance.
