The Right to Silence is a very important part of the modern rule of law and national criminal justice system and is gradually recognized by the international community in general, many countries in the world, has formed a relatively complete system of silence. More and more countries are beginning to respect and protect human rights. However, China will not include criminal proceedings Silence. This paper describes the definition of the Right to Silence, the emergence and development, and the debate of the right to silence, and actively explore the necessity and feasibility of the establishment of Criminal Procedure Reform in China and, as well as the preliminary idea of establishment of Silence with Chinese characteristics, expectations to improve our judicial system and ultimately our country justice. As our rule of law advancing and the situation of legal system constantly improving. The Right to Silence that is given to the suspects show the human rights situation of the suspect and accused in China, and the progress of the degree of criminal proceedings civilization.
