Research On Hearing System Of Civil Execution

Hearing System of Civil Execution was once a hot issue of legal theory,legal practitioners have also carried certain explorations. Hearing System of Civil Execution was quoted and constructed in judicial interpretations about implement.But now, a national unified Hearing System of Civil Execution was not established yet.I engaged in civil Execution about 10 years. I was aspired by the consequences and impacts of unstandard execution, preyed to set up a national unified system of Civil Execution. In this paper,I combined my own experience and legal hermeneutics, comparative jurisprudence sociological interpretation. In this paper,I first stated the overview of Hearing System of Civil Execution, then I stated the legislations of Civil Execution Hearing System in China and the necessity of the construction of Hearing System of Civil Execution from theory and practice, finally I established the principles and scopes of Hearing System of Civil Execution,also established the operating procedures and relief system of Hearing System of Civil Execution. Compared to previous investigation, I contended the necessity and urgency of the Hearing System of Civil Execution, and constructed relevant procedures of Hearing System of Civil Execution. Although my investigation was superficial, I also hoped my investigation could promote the civil implementation and the construction of Hearing System of Civil Execution.
