Research On The Legal Relationship Of Sublease

Sublease is a common phenomenon in the market economy. The legislative pattern of sublease has three forms:restrictionism, laissen-faire, distictionism.Restrictionism is adopted in China.It is necessary to change the legislative forms for it's defection in theory and practice.The beginning of the article defined the concept of sublease, compared sublease with other similar concepts,and finally analyzed the nature of tenancy.Second,the article listed the legislation of States to sublet behavior patterns and evaluated China's Legislation. Finally, the article analyzed the legal relationship of sublease in the existing legal framework in China.The author proposed to give lease rights to property protection, build the laissen-faire legislative forms, and put forward some suggestions and ideas to the details of the construction of the legal system.
