A Study On Legal Problem Of The Tort Of Internet Privacy

Along with the computer technology utilization,the internet popularization and rapid development of e-commerce, we have entered the information era.The internet almost invades our daily life of every nook. It is easy to mark internet on the traditional privacy. Network privacy and network privacy right concept emerged.At the same time network privacy tort cases happen everyday. Network privacy tort problems have blocked internet healthy and harmonious development. All countries are formulating relevant policies and laws to combat network privacy tort, protect internet privacy of their citizens. Due to the influence of historical tradition, privacy and internet privacy protection consciousness is weak relatively in China.The related laws and regulations on internet privacy tort are limited. In this paper, the author draw lessons from Europe and American relevant experience,combining with their national conditions of internet privacy tort, defined and analyzed the internet privacy tort, and find the suitable protection system for China's internet privacy.There are six chapters in this paper.Chapter one:The introduction. This chapter introduces the background of writing,research trends,the meaning and purpose of article expatiates,research methods, etc.Chapter two:First, interpretate the related concepts of internet privacy tort,focusing on defining the scope of Internet privacy.Second, expounds the specific performances of the internet privacy tort, analyzed the reasons of internet privacy tort.Finally,from analysis the imputation principle of internet privacy tort,constitutive requirements,civil liability methods and defenses from the perspective of tort law to provide theoretical reference for constructing the internet privacy protection system. Chapter three:Internet privacy protection status and comments of our country. Analysis the internet privacy protection status of China and find out the defects of current internet privacy protection. Chapter four:Internet privacy protection of foreign countries.Analysis the internet privacy protection legislation of major foreign countries,then contrast the advantages and disadvantages of lawmaking regulations pattern and self-discipline mode.In order to provide reference for our mode selection of internet privacy. Chapter five:Perfect the internet privacy protection of our country. Combined with Chinese specific conditions, this paper proposes some protection conception of Chinese internet privacy.
