The Analysis On The Policy Objective Of Competition Law

The policy objective of competition law has been the focus of attention of scholars. It is not only for its legal system relating to the construction, more importantly, it also can provide a clear legal practice guidelines, which for the process of rule of law are of great significance. The first part will introduce the background, research trends and methods. In the second part will define the concept, and explain the relationship between the policy objectives and other legal concepts. The third part focuses on the core policy objectives of competition law content - competition policy, through the different areas of research, select the United States and the European Union for studying. After comparing competition policy in transition and developing countries, I summarized the competition policy factors and obtained the enlightenment from European and U.S.A. In the part IV will return to the policy objectives of competition law in China studies. In this section, I will describe the competition policy through the development of different periods in our country and summarize up China's current policy objectives To current legislation, our country's goal of competition policy is a mechanism for maintaining fair competition in the market, focusing on efficiency, protecting the legitimate interests of competitors and consumers, maintaining the value of other public interest objectives as a whole .It is a wide range of competition policy objective selection method. This choice is to adapt to China's national conditions and economic development law. But the shortcomings of diversity is also evident. There are various conflicts and contradictions between the factors. To support a wide range of scholars did not make further explanations and solutions. This paper proposes to solve this problem for the first time. Policy objectives of competition law as established at the beginning, there are many issues to be resolved, such as administrative monopoly problems. At the last,the author puts out some constructive comments. The author believes that the key of the problem lies in the transformation of government functions and the relaxing government control. Only to coordinating with the relationship between competition policy and government functions, the domestic economy could be developped stably and the policy objectives of competition law could be smoothly achieved.
