Corruption Prevention And Control Countermeasures

Apperance of corruption always comes from the public power, and the essence of corruption is private utilization of the public power. For a long time, we have used the post-processing approach in the anti-corruption work of our country, which can not truly prevent the genaration of psychological motivations of corruption. In addition, the costs of corruption in China are too low, which make more and more criminals take risks to defy the law just for their private benefit, and also create the pathological phenomenon of endless corruption. The characteristics of corruption are diverse, and the social harm of corruption is becoming more and more prominent, which make us should change the basic concepts of anti-corruption. We should take the prior prevention as the main method, supplemented with the subsequent punishment, also we should take all kinds of means to eliminate the subjective and objective factors of corruption. In a word, we should take the prior prevention and subsequent punishment ways to restrain the corruption fundamentally. In this paper, I have made analyses about some cases of corruption at the social and individual points of view. According to the comparative and empirical methods, I have made some exploration and researchs, focusing on the improvement of corruption law,the resaon of existence of corruption and the prevention and control measures, trying to suppress the genaration of corruption motives from the source, to prevent the opportunities of corruption from building of the law and institution, and to prevent and control the probability of corruption effectively.Besides the introduction, there are three chapters and about 30 thousand words in all. The main contents of this paper are about the brief description of China's current situation of corruption,the generating reason of corruption and the prevention and control measures of corruption.Chapter one is about the brief review of the China's current corruption, I have made a generalization of the current characteristics and adverse effects of corruption. Through the way of document analysis, I have made the systematic analysis of lots of the judiciary documents and cases nearly 30 years and genaralized the current characteristics of corruption in China. At the same time, I have analyzed the adverse effects corruption caused in politics, economics, culture, and society through the empirical research method.Chapter two is about the analysis of generating reason of corruption, I have elaborated the social and individual factors. Thought the method of case analysis, I have devided the reason of corruption into social and individual factors after the systematic study of the subjective and objective of criminal. The social factors are related to the politics, economics, culture, law and family ; the individual factors contain the requirement, Character, will, temperament, beliefs and other factors. The social and individual factors are an organic whole, so we can not regard the reasons separately.Chapter three is about the prevention and control of corruption in China. Based on the condition of our country, meanwhile according to the study of experience and achievements of foreign countries, I have proposed the strategy from the economic, legal, regulatory and individual training parts.First, we should speed up the economic development to restrain the generation of needs of corruption. The essence of corruption is that the normal requirements of the individual changes abnormally while they can not be satisfied. Therefore, we need to promote the economic development and lay a solid material foundation; to improve the treatment of civil servants appropriately and inhibite the undesirable needs; at the same time, to establish the modern enterprise management system in order to reduce the chance of corruption.Second, we should improve the legal system and enhance the deterrent power of law. As the logical starting point of human evil nature, We should develop systematic anti-corruption laws and regulations, improve the provisions in anti-corruption, modify the improper regulations in the Criminal Law and establish protection system of the whistleblowers.Third, we should improve the regulatory mechanism on the criminals. Perfect regulatory mechanism is the necessary guarantee for the legal system to function effectively and the power to operate normally. The Discipline Bureau, Supervision Bureau and Anti-Corruption Bureau should work together to improve the efficiency of anti-corruption work; To enhance the awareness of supervision of the media and public in order to approaching the National Anti-Corruption; Meanwhile, the establishment of financial real-name system and the property declaration system will make the monitoring more clearly. Fourth, we should strengthen the individual cultivation to prevent the generation of the criminal psychology. Humans are social beings, who requires the basis of the uncorrupted social cultural environment, what's more, in order to truly enhance the individual's personality training and prevent the generation of the psychology of crime, we also should work hard to learn and master the social culture and social norms.
