The girl sex crimes also exists defects in legislation. From the constitution of crime, the objective elements of girl sex crimes, having sexual intercourse with a girl and acting indecently towards a child overlap partly or wholly. Women are endowed with sexual independence objectively. It deviates from the legislation purpose of protecting the women's rights and interests. From the respect of the criminal penalty, the distribution of penalty is unscientific and violates the criminal law principles of suiting punishment to crime. It is easy to indulge the criminals in judicial practice.With the method of comparison, the essentiality of abolishing girl sex crimes is analyzed from the view of ethical culture and legal theory, The author holds that this crime should be abolished by the way of criminal law amendment. It should be included the crime of having sexual intercourse with a girl under of the age of 14 and acting indecently towards a child.
