Chinese financial market is current in the beginning of the development, thus the protection of financial consumer protects the financial market as well. The consumer will lose faith in the market and gradually quit the market if their rights are ignored. Improving local financial judicial system through drawing on foreign practice of financial laws and regulations, which protect financial consumers, becomes one of the most important means to stabilize the market. Therefore, the financial regulatory commission should legislate laws and regulation in order to clearly define the rights for consumers and obligations for institutions, and make sure relative legal aids are prompt, convenient and economic.This article focuses on the study of establishing Chinese financial consumer protection judicial system and falls into 4 chapters.Chapter one describes the theory of financial consumer protection including definition of financial consumer, current issues of financial market and the necessity to establish relevant judicial system.Chapter two concerns the foreign practices of protection mechanism that comparing European Union, United Kingdom and United States of American's regulatory system. The foreign practices could provide experiences to legislate our unique laws and regulation.Chapter three defines the rights of consumer and the obligation of market maker. This chapter includes two sections. The first section analyzes the rights and obligations from the views of rights to know. The second chapter indicates the issue from the standpoint of fair trading.Chapter four is the key part of this article, which represents the conceptualization and framework of the protection judicial system. It suggests the financial consumer protection should be added to laws and regulations, and explains the reasons through three perspectives: improving consumer protection, strengthening financial institution regulation and mending judicial system.
