Research On Teh Reading Files Right Of Defense Lawyer

In criminal procedure, Defense lawyer plays an immeasurable role in protecting the rights and interests of criminal suspects and defendants. Lawyers'Defences usually begin with criminal facts and the law. Reading files is a basic right,on which defense lawyer can know criminal facts, and then find applicable law.However, in China's current judicial practice, Reading files is one problem of which bother lawyers most. As the human rights are concerned, perfecting our defense lawyer reading files system is imperative. Based on this, the author analyzes the significance of comprehensive reading, combines the current legislation and judicial practice, learns from the legislation in Two Legal Systems, and then puts forward suggestion on improvement in lawyer's reading files.This text is divided into six parts. The first chapter is an overview of the reading files right, mostly about the significance of comprehensive reading. The second chapter analyzes the cause of the reading files problem. The third and fourth chapter is legislation and practice in China. The fifth part introduces the legislation in Two Legal Systems. Based on the above, in the sixth chapter, the author puts forward advice on improvement in lawyer's reading files.
