The Study On Public Interest In Anti-dumping Law

With the development and prosperity of international trade and the continues adjustment of countries tariff policy, there has been a growing number of anti-dumping cases with high frequent of using anti-dumping measures. However, there was probably large percentage of abusing anti-dumping measures. Apparently the anti-dumping has already became a trade protectionism tool for some countries, some of which have paid more and more attentions on how to take advantage of it. So it's very important to make limits of anti-dumping measures. It's a pity that not so many counties realize this point and make a clearly rule for this.This project means to provide some useful ideas and suggestions for the public interests in anti-dumping measures by analyzing and discussing the related rules of the public interests in anti-dumping measures in World Trade Organization (WTO), Europe, Canada and the United States etc.There are totally four sections in this report:the 1st section is the introduction of background, including Dumping and Anti-Dumping law, the factors of the public interests and the necessary of making rule for the public interests in anti-dumping measures. The 2nd section is mainly about the standards of the public interests in anti-dumping measures. And in the 3rd and 4th section, we provide suggestions for interested party and vetting procedures by using contrastive analysis way to analyze the related law of WTO, Europe, Canada and the United States.The conclusions in the project include the following:the public interests is necessary in anti-dumping measures; clearly definition of the public interests and its factors could be helpful for realizing its value in anti-dumping measures; And the range of party in interest are:Intimate Apparel Manufacturers Association, Import Merchant, Industrial User and Consumer's Organization. The flow path of public interest test is: At first, the right side ask for public interest injury, and the interest party hand in related materials within the specified time, then, the competent-authority-in-charge decided if it needed to go on the public interest test, if so, the public hearings should be hold, and the agency-in-charge give the final judgment.
