Research Of Labor Rights Protection Of China To Japan

Since the beginning of the 21st century, along with the development of economic globalization,and the explosion of China foreign economic trade, the Chinese laborers to the world increase rapidly. According to the data from Chinese Commerce Department, until the end of July 2008, the amount of Chinese laborers in foreign country is 7911 million, laborers send by our country reached 44116 million. Along with the increase of the laborers in foreign country, all sorts of problems are one thing after another. One particularly notable problem is the protection of labor rights.The rights of Chinese labor engaged in all walks of life in overseas have been violated occasionally, and the number of infringement increases rapidly. These arouse the attention of our government and society. The main problem which Chinese overseas laborers face is the property dispute, meanwhile about personal safety, work environment and so on. However, the problem emerges when the laborers are working, and because of the dissembling of accepting units and the concealing of laborers self, the problem is hard to realize by society and the media. So, it catches less attention than the frequent attack on large Chinese capital organization and the personal injury. It also causes the relatively backward of the related research.Japan, as the neighboring country of China, is one of the Asian counties which accept Chinese laborers most, also is one of the main locality where the rights of Chinese laborers are violated frequently. All sorts of dispute which Chinese laborers faced in Japanese enterprise are complex and with the particularity of Japanese services. So, to solve these problems, the Japanese local law should be considered and corresponding solutions for the specific problem. This article puts a court case of Chinese laborer in Japan as an example, by the investigation and research methods, study the rights protecting problem of Chinese laborers in Japan. The article starts from the current situation and effect of labour service in Japan, analyses Japanese trainee system, and the China-Japan issue of rights protecting of Chinese laborers. Finally, to solve these problems, the corresponding countermeasures are put forward. It's hoped that the publish of this article can bring others'valuable contributions, lead the educational circles and people to pay close attention to the disadvantaged groups of Chinese laborer in Japan.
