The Study On Migrant Worker's Struggling For Right

The social, group of migrant worker formed during the process of China economic and social development. They play an important role in the development of urbanization, industrialization and modernization. However, in fact, the event of infringement of their right occurred at times, such as withholding and arrears wages, compulsive overtime without payment, harsh working environment, the difficulty in identifying and asking for compensation for industrial injury and disease. These violations influence migrant workers legal right heavily. Once their living condition is threaten, they may struggle for legal rights. So the study on migrant worker's legal rights, the mobilization, pattern, strategy has important influence on the relief of labour-management conflict, social contradict. This study also can help to maintain the social order and harmony.Based on the research on investigating the situation of migrant workers rights, this paper mainly study on the condition, mechanism and strategy of struggling for rights. This study concludes that the migrant worker struggling for rights is like a struggle between cracks. The existence of political structure is both the premise and objective condition of the occurrence of current migrant worker's struggling for rights. Struggling for rights needs migrant workers combine their subjective initiative with adherence to objective laws to mobilize both emotion and resource. The impairment of survival benefit is not only the best factor that can lead to mobilization, but also the transfer cord of struggling for right event. Emotional mobilization invoked by triggering event, increases the migrant worker's deprivation, resentment and injustice. Finally they reach a consensus of crisis and become the motive power of resource mobilization. Meanwhile, resource mobilization is the process of mobilizing potential participants, economic resources and social resources by migrant workers. The resource mobilization can be achieved under the following conditions:the informal organization between villagers, social support from relatives, friends and fellow workers, migrant workers'identity on the drift of culture, the aggregation of the subject of struggling for rights, convenience of modern communication methods. Through the interaction and inter-intensify between emotional and resource mobilization, the migrant worker's struggling for rights produced. This struggling is rational activity for migrant workers under the condition of survival benefit impaired. During the process of struggling for rights, the migrant workers comply with the following strategy, such as "try peaceful means before resorting to force", not cross the line, through legal ways and groveling.The migrant worker's struggling for right has the following features, such as leading by financial benefit and opinion leader, limited organized and social resource, and been compelled to react. So this struggling called "struggling in the crack" because it is squeezed by local government and enterprise. They are forced to game with government and enterprise in order to get a survival space. With the development of reformation, the degree of social structural adjustment increases, the social contradictions becomes obvious and the rapid development of network, the trend of migrant worker struggling for rights may have such features:the transferring and extension of struggling space, the complexity of involved subject, the combining of different type of struggling events and the increasing degree of struggling event. Because of the commonly existence of structural resent, the opposing between vested interest group and non-interest group, the influence of unfair and injustice, the uncertainty of migrant worker's struggling for right increases, especially when accompanying with the violent factor, the struggling may become the fuse of mass disturbances.
