At present, China is in the primary stage of socialism. Our social security system is Inadequate yet. Social charities for those that are in distress, the economic hardship, disaster relief need a large number of donations to complete. Social donations make a contribution to the social development of our charity. However, due to the lack of effective supervision and regulation, many unsatisfactory situation have been arose in social fund-raising activities, such as constant assessed contributions, usual misappropriation of donated property, coming of social fund-raising disputes. These problems made our Loved Hearts beaten, hindered the awareness of the full social charity, seriously affected the healthy development of China's charity. To solve these problems, we must clarify the legal nature of social fund-raising, improve related laws and systems. In view of this, I summarized the problems of social fund-raising by the case, analyzed the causes of the problem and proposed solution to the problem of legislation.This paper consists of the following three sections, Introduction, body and conclusion.Part one:Introduction of the case and the problem. The second part is introduced through the case, which leads to key issues discussed in this paper.Part two:Legal analysis of the case. This section describes the concept of social fund-raising, characteristics and legal nature and combines the theory and the practical case and analyzed the legal problem concerned in the case.Part three:Perfect Legislation to address social issues of fundraising ideas. This section concludes the universal issues existed in social fund-raising, analyses the cause of the problems and proposed perfect legislation to address issues related to it after having referenced the results about legislation of America.
