On The System Of Civil Compulsory Plea

The system of civil compulsory plea is not only essential to guaranteeing the equality of the parties'right of action in civil action, but also helpful to realizing the procedural justice and increasing the efficiency of action. The establishment of the scientific system of civil compulsory plea is beneficial to sorting out and inducing the focus of disputes of the parties. It also makes the objects and scope of court trials clear, and raises the efficiency of action as well. The thesis begins with the concept of the system of civil compulsory plea, compares and analyzes the legislation concerned in the countries of the two legal families in order to promote the learning from the experience of foreign countries. Based on the research in the existing system, the thesis puts forwards suggestions on improving the system of civil compulsory plea so as to make contribution to the legislation concerned in China.
