On Modification Of The Representative Action System

China's representative action system comes into being under the social circumstance of a lot of group conflicts taking place. This system had drawn many lessons from the experience of America's class action system and Japan's deputy action system and also summarized judicial practice of courts in our country. This system makes up the shortfall of traditional single action and joint action in solving new types of group litigation. It plays a very important role in solving group litigation. However, there are many problems in the application of the representative action system, which does not correspond to the original intention of this system. For its own defection and the judicial environment, the representative action system has not been widely applied in the practice. Therefore, this essay analyses the reasons which cause unsuccessful operation of the representative action system, and puts forward some ideas and suggestions on the modification of the representative action system on the basis of inspecting and benefiting from the related systems of foreign countries.
