Perspective On The Constitutional Protection Of Private Property Rights

Private property is not only the basis material for human existence and development, but also the hotbed for tending civilization. Because the development of modern civilization, Market economy and Constitutional Civilization's voice for the protection of private property has become the strongest voice of the time. In this historical context, strengthening the constitutional protection system of private property right has become the trend of the time.This paper starts from analyzing the related concepts'differences and relations of private property right., grasping the core and essence of the concept of private property right: beneficialness and exclusiveness. The second part of this paper combines with western scholars'research on private property right, and finds ideological source for constructing the constitutional protection system of private property right. In addition, adhering to Marxism is the basic characteristic of socialism, so, the third part emphatically explains Marxist theory of private property right, which is the strongest constitutional basis for constructing the constitutional protection system of private property right. Then, the forth part of this paper systematically describes the tortuous developing course of the protection of private property since the founding of our state, and the current situation and defects of it, which leads to the three measures for constructing the constitutional protection system of private property right: Set up equal protection system of public and private interests; Build up equal constitutional Protection system of private property and tax; Strengthen the construction of department Law protection system.
