The Study On Rights And Interests Guarantee Of Land-losing Peasants During The Process Of Hainan Urbanization

Urbanization is the unavoidable way for promoting economical and social development and achieving modernization. It is the objective requirement of the economical and social development in accelerating the urbanization process. With the accelerating process of urbanization, a serious of underlying conflicts affecting economical and social development were solved. At the same time, the process itself caused a multitude of problems, especially problems about land-losing peasants'rights.In the process of urbanization, a lot of rural collective land is expropriated, so the number of the land-losing peasants is increasing unceasingly. There exist problems such as the defects of the land system and illegal land expropriation, the low compensation standard and badly roughed misappropriate compensation in concrete operation of land expropriation policy, also many contradictions such as land-losing peasants social old-age security, the jobs of the future development opportunities and long-term livelihood etc, all the above cause the loss of land-losing peasants' rights during the process of land expropriation. If the problems of the land-losing peasants being not properly solved, social contradictions will be aggravate. It is unfavorable to the sustainable development of rural economy and new rural construction of socialism, neither to the construction of urbanization and modernization. In particular, while Hainan is vigorously promoting construction of the international tourism island, it is the times requirement of the international tourism island construction to ensure the rights and interests of land-losing peasants. How to ensure the rights of land-losing peasants is a hot topic in academic circles, it is also the problem that needs to be solved urgently by the government.In order to solve the problem, this thesis made a systematic and exploratory research in system construction and application of Hainan land-losing peasants' rights guarantee in the urbanization process based on the summary of domestic and foreign research and the system practice. This thesis carried on an on-the-spot investigation in the aspects of overall number, characteristics, living situation, rights and interests protection status, and the attention of their rights of Hainan land-losing peasants. It sorts out and summary the main performance of the loss of rights and interests of the land-losing peasants and highlights their voices and eager. Then, it analyzes the deep reasons of the loss of the land-losing peasants' rights, specifically including the defects of land requisition system itself, the defects of common resettlement security pattern of land-losing peasants and the land-losing peasants own factors. On this basis, through the analysis and comparison of some better areas in land-losing peasants' rights protection in Hainan province, this thesis summarizes the successful experiences, and puts forward to policy suggestions in protecting the land-losing peasants' rights in the following four aspects. They are improving the rural land requisition system, making the peasants' land rights system perfect, strengthening the government responsibility, and establishing a new land-losing peasants' security system. Through this thesis, I express my hopes that the rights and interests of the land-losing peasants be protected effectively, and the peasants could fully enjoy the fruits brought by industrialization and urbanization.
