In recent years tourism has developed rapidly,tourism travel contract is frequently used in people's daily life, traveling adds color to people's life, but it also brings a lot of disputes. How to protect the lawful rights and interests of both sides in tourist contract, how to regulate tourism market, how to safeguard the healthy development of China's tourism industry, has become an increasingly urgent issues. Our tourist contract legislation is blank. It can not satisfy the ever-growing tourism market, therefore, strengthen tourist contract research has important theoretical and practical significance.According to the basic principle of civil law, contract law and theory, using induction, comparative analysis, empirical analysis research ,aiming at Chinese travel contract legislative situation and dilemma, the reference of several foreign representative national, regional tourist contract legislative, judicial practice experience and the relevant international conventions, based on research from the basic theory of tourist contract, analyzed deeply in detail the important problems and tourist contract substantial contents, combined with a specific case of empirical analysis, and finally to how perfect our country's tourist contract, I put forward some counter measures and suggestions,hoping to establish Chinese characteristic tourist contract law to provide theoretical and practical support, contributing our own strength.
