Research On The Punishment Of Unit Crime

Unit crime is an concept relative to the natural person crime, a special kind of crime pattern in criminal law,with China's reform and opening-up started and the rapid development of social economy, the unit crime volume increases rapidly,although many scholars of our country have published many works to discuss the unit crime, but because it has not been paid enough attention and is involed with such broad areas that it is still a weak link of criminal law research, especially in the field of penalty,the backwardness of theory can easily leads to many problems in the legislative and judicial practice, so a thorough investigation in the field of crime unit is necessary to guide the judicial practice.This thesis is divided into three main chapters.The first chapter mainly introduced the criminal responsibility body of unit crime, through analysis of numerous domestic theories,double subject is denied,single subject is affirmed,the responsibility of personoriginate from unit,it's the basis of the research,.The second chapter bassically discuss the single punishement of crime unit,which is divied into three categories by domestic sholars. This thesis points out the shortcomings of the existing theory ,presents some suggestions to improve and perfect the crime unit single punishment.The third chapter basically introduces the Unit Recidivism,although there is no space for Unit Recidivism to exist in present criminal law,but the admission of Unit Recidivism is tendency, and then propose some Suggestions for the Construction of Unit Recidivism.
