The pirates in Somalia are threaten to the passing ships. The UN Security Council has adopted a resolution Noï¹’1851 which authorize all countries of the world to use their armed forces to hit Somalia pirates. The resolution authorize all nations to stop pirate activities and sea-armed robbery. All countries can adopt all possible means including land or air force to do that with the permission of Somalia government. Though the involvement of government has prevent pirate to a certain extent, a series of problems on international law caused by Somalia pirates affected scholars in many countries. Most of all is piracy ransom. It is showed that previous pirates hijacked ship to rob the goods or existing property in the ship, and they may hurt the crew. Somalia pirate presents different characteristics. They simply withhold ship, cargo and crew to obtain ransom without doing damage to the ship, cargo and crew. The discrepancy that the form of piracy is different with the existing international law system makes Somalia piracy ransom become focal issues. People don't know how to pay and apportion it. This article is based on the difference of Somalia pirates'behavior, and will discusses the likelihood of apportioning piracy ransom.The text is divided into four chapters. The first chapter mainly introduces the Somalia pirates'behavior characteristic and the problems caused by it. It analyzes the particularity of the Somalia pirates'behavior from the definition of piracy. The second chapter analyzes the formation of the Somalia piracy ransom, and divided it into three parts: ship ransom, goods ransom and people ransom. Then it discusses the necessity of ransom's payment in every part. The analysis will lay the groundwork for below. The third chapter against piracy ransom nature makes a further analysis. It compares the piracy ransom with particular average, general average and maritime salvage to find out the similarities between them. The fourth chapter focuses on the possible solutions of piracy ransom. It put forward the tentative idea that P&I and government agencies will play a role in apportioning piracy ransom in the existing insurance law system. I hope it will provide theoretical support to solve the problem of Somalia piracy ransom.
