Feasibility Analysis On Inspection And Supervision Of The Review Procedure On Death Penalty

Although China has been attributed the approval of the death penalty to Supreme Court, the provisions of the death penalty review procedure in our law is too simple , the unity of the setup of review body make the death penalty without the right checks and balances and oversight review, the legitimacy of the program's running is questioned. The recover of right is only the increase level of the exercise of power, the running program of the power is even more important. To improve the death penalty review procedures, the scholars are also constantly exploring new ideas, new methods. In this essay, by analyzing the defects of death penalty review procedure, demonstrate legal basis for the law of the inspection and supervision, and finding a reliable legal basis in constitutional, proposing the guiding philosophy and basic principles on the process of exercising inspection and supervision, and deal with different kinds of relationships. The feasible suggestions on the inspection and supervision for the death penalty review procedures is put forward on this basis.
