On The Study Of The Improveents In The Civil Liability System Of Securities False Statement Of Our Country

This article focuses on the procedural and substantive analysis of Securities civil suits based on the study of the case of JOTE's false statement,and makes some reflections and puts forward some suggestions to the system of civil liability in China's Securities law and regulation in the light of foreign practice experience in this area , expctining to be some help in the improvements of the securities civil liability system in our country. The procedural aspect focuses on the analysis of pre-litigation procedure and litigation models. The substantive analysis wil discusses the causation in damage and the CPA civil liability.This article is divided into three chapters, cosisting of introduction,main text and postscript.Problems and dangers facing China's securities market, together with methods and significance to solve these problems are briefed in introduction. The first chapter briefly introduces the case of JOTE's false statement and the procedural and substantive problems in this caseThe second chapter analyses the procedural problems in securities civil tort compensation of our country. The articles first discuses the problems of the pre-litigation procedure and litigation models in the case of JOTE's false statement and then makes some recommendations on the improvements of the securities civil liability system in our country form the viewpoint of the comparative analysis of relevant foreign legislations.Chapter three discusses the substantive problems in securities civil tort compensation of our country including the causation in damage and the CPA civil liability.This chapte will first introduce the problems in the case of JOTE's false statement, and then make reflections and Suggestions to these probles, based on the review of the relevant legislations of our country, form the viewpoint of the comparative analysis of relevant foreign legislations.This article is only a exploratory study, holping to make some contribution to relevant legislation.
