Small property house discussed in this thesis refers to the house built on farmers' collective land but purchased by the other collective economic organizations or by individual. And the house has no certificate of house property. This is a peculiar phenomenon caused by our country's binary system of landownership. In recent years, the price of city's commercial housing has remained at a high level but the inhabitant's purchasing power is relatively weak. At the same time, the Small property houses are springing up like mushrooms in big cities because prices of these houses are a third to a quarter of the commercial housing. Now, the small property house has been a hot topic which attracts the attention of our government and the whole society.According to our existing policy, the small property house is not recognized by laws. Therefore, the legal study on small property house has sense on both theory and practice.First, the small property house is a result of the urbanization and our binary system of landownership. It not only touches on the development of real estate and the establishment of housing system in city but also on the perfection of land system in country, the protection of farmland resource and the protection of farmers' interests. Firstly, the thesis explains why the small property house comes out. Later, it analyses the contradiction and coordination between small property house and our existing legal system to give guidance on solving problems of the small property houses.Secondly, the final purpose of this thesis is to solve practical problems. This article will firstly study the reasons and current situation of the problems of the small property house and then, will propose legal avenues to solving the problems. The thesis not only focuses on the development of economy, the sustainable utilization of resources but also on the livelihood of people and the stability of our society. As a result, our land legislation and property legislation can be more perfect. What's more, the interest of peasants and purchasers can be protected better. The method helps to promote the diversification of our property market, and expedite the integration of urban and rural areas. This article provides with some policy references to solve problems of the small property houses. So it's a thesis with realistic significance.
