On one hand, matrimonial debt institution has a great effect on the stability of family and the equity between couples. On the other hand, it also affects the security of civil transactions. However, the articles about matrimonial debts in our country's current marriage and family legislation are not perfect. The defects both in practice and procedure make it difficult to utilize related regulations and cause plenty of questions in practice.Therefore, in order to provide operational rules for resolving the disputes about matrimonial debt reasonably, it is very urgent and meaningful to construct complete matrimonial debt institution in our country's current marriage and family legislation. This article is trying to provide some legislative suggestions based on the research about other country's legislations and our country's legislations and practice. I hope these research and suggestions could be helpful to perfect our country's matrimonial debt institution.The thesis includes six parts.The preface introduces the object, value and situation of study on Matrimonial Debt.Chapter1is Study on Basic Theory of Matrimonial Debt.This part points out the conception and nature of matrimonial debt,and compares it with related concepts.Chapte 2 is Study on Matrimonial Debt of China.This part provides an introduction of current legislation in our country.It analyses some real cases and reveals legislative defects. Chapter 3 is Comparative Study on Abroad Legislation.I n this part, matrimonial debt legislation of civil law countries and commom law countries are compared and studied.Chapter 4 is Suggestion about Improving Current Legislation of China.It provides some legislative proposal both from the substantive and procedural.The conclusion is the summary of full text.
