Study Of Antitrust Regulation Of Exclusionary Practices In The New Ecomomy

With the development of new economic, exclusionary practices in the new economy business become a problem which can not be evaded in antitrust enforcement. But the new economy business has its own characteristics, which make its market share achieve more rapid and make market power consolidation, antitrust regulation of exclusionary practices in traditional industry can not apply to it entirely. New economy business in China is rising, so it is important for Chinese antitrust enforcement in new economy business to study this issue. This thesis Based on analyzing basic theory and specific case of new economy and exclusionary practices, this thesis discusses whether exclusionary practices in new economy business is market evil, and the traditional antitrust enforcement can effectively regulate exclusionary practices in the new economy industry. This thesis is divided into four chapters to introduce and discuss these issues.Chapterâ… is named antitrust regulation on exclusive practices. The author defined the concept and classification of exclusionary practices, and refers to how to regulate it in the traditional industry, and how to identify enterprise's market monopoly power which exercise of exclusionary practices. Then refer to legislation of exclusionary practices in European Union, the United States and China. Through introducing development of the theory of exclusionary practices, the author further elaborated for the exclusionary practices and its effect on competition. The author gives a concept of the new economy and new economy-related business, and analyses characteristics of new economy which is different from traditional industries.Chapter III is named antitrust regulation on exclusionary practices in new economy business: cases and analysis. The author analyses and comments cases of exclusionary practices in new economy business which happened in the U.S. and the EU, and proposes measures to response antitrust challenges of new economy based on their experience.Chapter IV is named research of legal regulation on exclusionary practices of the new economy business. Firstly, the author analyses cases of exclusionary practices in new economy in China. Secondly, the author proposes advice for antirust enforcement of it the case in China. Conclusion summarizes the contents of previous text, reiterated the point of view of antitrust regulation on exclusionary practices in new economy.
