Research On Truncated Arbitration System

Over the long run, truncated arbitration, which did not arouse much concern by academic circles, was not a common phenomenon in previous practice of international arbitration. In recent years, some factors of truncated arbitration is being involved under some arbitration rules which are enacted by the arbitration agency. Some of them, occasionally, made some awards by the truncated tribunals. United Nations Commission on International Trade Law also discussed the problems about truncated arbitration when consulting UNCITRAL Model Law on International Commercial Arbitration, in the meantime, truncated arbitration has gained increasingly attention in academic circles.This thesis affirmed truncated arbitration system, and having accepted this premise, did a research on this issue. The thesis firstly makes research on the conception, origin and development of truncated arbitration. Secondly, the author discusses the necessity and legitimacy of truncated arbitration, laying a basis for subsequent research. Thirdly, by means of analysing international treaties and arbitration rules, the research of the feasibility of truncated arbitration system is conducted in chapter three. Then, the author discusses how to device the truncated arbitration system, including international arbitration rules research, arbitration law research and the modification of international treaties. Finally, on the basis of discussing the practical meaning of researching truncated arbitration system, the author indicated that how China responds in such circumstance.
