Air transportation is one of the most common transportation way in the current world ,it plays a significant role in the international economy. The air carrier offers safe,effective,efficient transportation for passengers. Yet air transportation accident happens frequently, there will be more disputes between passengers and the air carrier . There is no disputes to give compensation to passengers suffers from physical damage in air accidents. But on the other hand , it is of great disputes on the issue of offering a mental compensation for death or injury to international air passengers . This essay first analyse the relative clause of international convention ,then some cases from both international and domestic to make sure if it is feasible for mental damage compensation. At last is the suggestion for "Chinese Civil Aviation Law ".Preface introduces the background and significance of writing the articleChapter 1 describes the overall situation of mental damage and mental damage compensation .Chapter2 describes the relative clouse of international convention. First is the Warsaw System and then the Montreal System .Chapter 3 brings forward international judicial practices on mental compensation in international aviation ,including the USA, England .Chapter 4 is judicial practices in China and some legislation suggestion for the "Chinese Civil Aviation Law ".
