Legal Study On Deternination Making And Enforcement Of United States' "Section 337" Investigation

In world trade, it is a trend to combine the IP protection and the trade, just as what the US is doing now. In the legal system of US, there are"section 301"which protects the exportation and"section 337"which protects the importation."Section 337", which dates back to the Depression of US when the trade protectionism prevailed, has been a significant IP trade barrier of US through 80 years'development.In the thesis, I study the following parts of the"section 337"topic.Part one, the history of"section 337".Part two, the legal analysis on determination making of"section 337"patent cases. Part three, the legal analysis on the remedy and enforcement of"section 337".Part four, the measures to solve problems concerning"section 337"and the IP insurance ,which can provide money for the litigations concerning IP conflicts. In the thesis, I mainly analyze the"section 337"positively by studying many cases.
