Court entrusted mediation is a legal system that the people's court entrust the related units, organizations or individuals with the mediation of civil disputes being sued on the agreement of parties. Its generation and development background is the large increase of civil disputes and relative lack of judicial resources. In order to solve this problem, our government advocates establishing diversified dispute resolution mechanism, and the entrusted mediation emerges as the times require. It also plays an important role in solving civil dispute, reliving litigation pressure and maintaining social stability.Based on our existing law and courts' practical experience, this paper will analyze the essential question of entrusted mediation and give some suggestions about the existing legal system. It is the author's hope that this thesis would contribute humble efforts to establishing and perfecting the diversified dispute resolution mechanism.This paper includes four parts:Partâ… .Concept, characteristics, the legal relationship involved of Court entrusted mediation and its legal nature and relationship with the relative legal system would be expounded.
