Reconstruction Of China's Judge Disciplinary System

The degree of perfection of judge disciplinary system is an important symbol of whether a country's judicial system is democracy or not. Imperfect judge disciplinary system not only affects the authority of judiciary, but also threatens judicial independence and impartiality. China's judge disciplinary system, no matter legislatively speaking or in specific practice, still has enormous problems, which is far away from being perfect. Mainly as the irrational setting of disciplinary agencies, the unreasonable distribution of power, the unscientific disciplinary reasons, the disciplinary procedures with a tint of administrative order, and the disciplinary measures failure to reflect the characteristics of professional judges. There are three reasons of these problems:China's special conditions, imperfect judicial supervision and low quality of judges. To reconstruct China's judge disciplinary system and list detailed recommendations, an independent disciplinary committee should be established, detailed disciplinary reasons should be specified and standardized and disciplinary procedures and punitive measures should be rebuilt.
