Study On The Criminal Jury System

The jury system is a lawsuit system that the non-professional judges take part in the adjudgement as a justicer. These citizen and the justicer can judge of the civil case and the criminal case. The jury system, the safeguard of individual and the method of people's direct participation in judicial actions.Nowadays the jury system is implemented in the U.K. and the USA as there representative of countries with common law system,while assessor system is employed in the Germany and Franee as the representative of countries with civil law system. The decision about rule on the perfection of the people's jury system begin to implement on May 1,2005. As an important act in our judicatory reformation, the jury system has have an important effect to our nomocracy. But at present,there exist many a problem in the Chinese jury system. This thesis will do more researeh about how to improve our trial system of people's jury system in the following three chapters.The first part introduces the origins and the development of the western jury system. The original jury system originated from the slavery at the earliest stage in Athens and Rome while the modern jury system regards medieval Britain as its headspring and developed in the USA.The contemporary British jury system begins to turn into assessor system after its reformation and evolvement in the countries with common law system.In modern times, every nation tries to reform and perfect the jury system according to its practical situation.The second part describes the status of the jury system in the Asian countries and refer. It mainly introduces the jury systems of Japan and South Korea. Both of the governments of the Japan and South Korea made a change of the jury system in Western on the national judicial circumstances and carried out them to fit for local development. The process has much for China's Judiciary to learn.The third part evaluates and analyzes our current jury system, and describes how to reform and perfect our jury system. The article mainly introduces the evolution and actuality of our jury system. Aiming at the practice of our jury system, the article analyzes the existing problems of our current jury system, and raises specific ideas of perfecting the trial system of people's assessor. To improve and set up several provisions of the trial system of people's assessor on the problems of responsibilities, selection, management, etc;to improve and set cases for the jury several provisions on the aspect of the applieation of jury system; to perfect the legal system relative to jury system.
