With more and more people having private cars, it is more difficult for people to park. Underground garage which is built in the underground not only provides parking for the owner, but can conserve the land. Property Law provides the right of parking garage decided by the parties upon bonus. The provision can not guarantee the interest of the owner, because the contracting capacity and opportunities between the owner and the developer is different. As the law on the ownership of underground garage is rough, and the lacking of specific institutional arrangements, there are many disputes of the right of underground garage between the owner and the developer. The article points out that the underground garage is the proprietary part of differentiation ownership and community facility on the basis of legal attribute, so when we turn to the right of the underground garage, we need to balance the interests of the owner and the developer. Then the article discusses the basis of determining underground garage and points out that area pool as the basis has more rationality. At last, we need to introduce the statutory garage which is co-owned by all the owners while the other garage is exclusive part and we need to improve the registration system.
